Petitioner, who is in custody, seeks bail in connection with Kalyanpur P.S. Case No. 134 of 2017 registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
Informant is the father of deceased who in his fardbeyan has stated that his daughter was married to petitioner in the year 2013 and thereafter she was being tortured for nonfulfillment of demand of dowry, a daughter was also born from the wedlock. On 04.09.2017 at 12 O'clock in the mid night he received an information that his daughter has hanged herself. It is submitted on behalf of the petitioner that there is general and omnibus allegation about demand of dowry and
Patna High Court Cr.Misc. No.23933 of 2018(4) dt.30-08-2018 2/2 killing of her daughter in which all family members including this petitioner has been made accused. Charge-sheet has already being submitted in this case and according to the postmortem the death of deceased is Asphyxia due to hanging, and it is submitted that she had committed suicide. Petitioner is in custody since 04.09.2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 134 of 2017.
