In this case, the petitioner is seeking anticipatory bail in connection with Deepnagar P.S. Case No.218 of 2016, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code and under Section 27 of the Arms Act.
There are case and counter case from both the sides. In the present case allegation has been made that when the informant was grazing the cattle, the accused persons came there holding different lethal weapons and started assaulting him and also resorted firing, but no one was injured. Counter case has been lodged by the side of the present petitioner, wherein the
Patna High Court Cr.Misc. No.17783 of 2017 (6) dt.19-08-2017 2/2 petitioner has been shown to have caused fire arm injury. In support of the submission, learned counsel for the petitioner has placed reliance on the injury report dated 5.11.2016. Looking to the aforesaid facts and circumstance of the case, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Biharsharif, in connection with Deepnagar P.S. Case No.218 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
