Petitioner apprehends his arrest in connection with Bairgania P.S.Case No. 200 of 2017 registered for the offences punishable under Sections 366, 372, 373/34 and 120B of the Indian Penal Code.

Allegation against the petitioner is of abduction of married daughter of the informant.

Submission of learned counsel for the petitioner is that during investigation material has come that she was in talking term with another co-accused, with whom she fled away and petitioner has been made accused only on the basis of suspicion. Heard learned APP also, who has opposed the prayer for anticipatory bail stating that suspicion has been raised against the

Patna High Court Cr.Misc. No.31253 of 2018 (5) dt.07-08-2018 2/2 petitioner which will appear in so many paragraphs of the case diary and the girl is still traceless.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
