JUSTICE SANJAY PRIYA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Dulhin Bazar P.S. Case No. 32 of 2017 instituted for the offence under Sections 188, 353 of the Indian Penal Code and Section 10 of the Bihar Conduct Examination Act, 1981.
It is alleged that the informant was appointed as Centre Superintendent for Intermediate examination 2017 at Parasnath Kushwaha College. It is further alleged that when the deputed Magistrate and other members of staff were preparing to distribute the question papers to the students, all of sudden the petitioner entered the examination control room and had altercation with the Officers and staffs and also caused hindrance to the work at the place of occurrence.

Mere vague allegation has been made against the petitioner that he caused obstruction in the working of the members of the control room of Intermediate Examination. It is mentioned in paragraph-3 of the bail petition that the petitioner has clean antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Dulhin Bazar P.S. Case No. 32 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-3rd, Danapur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
