The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 452, 380, 382 of the Indian Penal Code and 25(1-B)a/26/35/27 of the Arms Act.

The prosecution case is that the five accused persons unsuccessfully attempted to steal the motorcycle of the informant when Vijay Mallah was apprehended from the spot on 04.01.2016. After 15 days of the occurrence Vijay Mallah was taken on remand by the police and on whose confession the name of the petitioner sprang up. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.23751 of 2016 (2) dt.26-05-2016 2/2 petitioner that the petitioner has no criminal antecedent and after 15 days the confession was obtained by the police under coercion to implicate the petitioner.

The aforesaid facts constitute ground for consideration of prayer for regular bail by the learned court below, preferably on the same day, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kisanpur P.S. Case No. 06 of 2016 pending in the court of learned Chief Judicial Magistrate, Supaul.

With the aforesaid observation, this application is disposed of.
