JUSTICE RAJESH KUMAR VERMA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 31-10-2025 In the present writ petition, the petitioner has prayed for the following relief/s:
"For quashing the order contained in Memo No.1073 dated 18.10.2024 passed by Sub- Divisional Officer, Sherghati, Gaya by which the place of thana which was proposed to be constructed at Khata No. 109 Plot No. 303 Mauza Sindugarh Thana No. 645 having a sufficient vacant land (Gairmajarua) Measuring 1.10
Patna High Court CWJC No.13262 of 2025(2) dt.31-10-2025 2/3 Acres in the name of Bihar Sarkar was changed at Mauza Kewla, Thana No. 646, Khata No. 358 Plot No. 16, 17, 18, 19 & 20 which is a disputed land and are belonging to the co-villagers which is totally bad and illegal as the abovesaid changed proposal has been made on a wrong vague and misconceived information and further for quashing the consequential order dated 05.12.2024 passed by the District Magistrate, Gaya by which the Senior Superintendent of Police, Gaya, has been directed to get no objection certificate w.r.t the abovesaid land situated at Mauza Kewla, for the construction of the building of the said Sindhugarh thana and further for quashing the order dated 01.07.2025 issued by Additional Director General of Police Bihar Patna by which the estimate has been accepted and Rs. 8,92,87,150/- which totally bad and illegal which is further for any other reliefs the petitioner may entitled to."

From perusal of the record, it appears that there is a dispute raised by the petitioner in the present Public Interest Litigation in respect to the selection of the site for the construction of a police station. Apparently, the same is a policy decision to be taken by the authorities concerned for the site selection for the construction of the police station. In case, if the petitioner is aggrieved, then he should approach to the competent authority.
3. Further, from perusal of the annexure P/5, it
Patna High Court CWJC No.13262 of 2025(2) dt.31-10-2025 3/3 appears that on the earlier occasion also, the petitioner has approached this Court where vide CWJC No.2957 of 2025 order dated 25.03.2025, where the said writ application was disposed of with the following observations:- "2. The learned counsel for the petitioner after arguing vehemently for some time realizing his difficulty seeks permission to withdraw the writ application with liberty to move before an appropriate forum in accordance with law.
3. Permission is accorded.
4. The writ application is dismissed as withdrawn with aforesaid liberty."
4. Considering the aforesaid facts, we find no merits in the present writ application, the same stands dismissed with a liberty that the petitioner may approach the competent authority for redressal of his grievance, if so advised. (Sudhir Singh, ACJ) (Rajesh Kumar Verma, J) Gaurav Kumar/- U
