ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and learned counsel appearing for the State.

Petitioner apprehends his arrest in connection with Town P.S.Case No.169 of 2015 registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. Case diary has been called for which has been received. Learned counsel for the petitioner submits that the informant in his earlier statement has not taken the name of this petitioner rather he has specifically taken the name of one Prakash Kumar who is alleged to have shot at his son who subsequently succumbed to his injuries. Learned counsel further submits that even the son of the informant had only named one Prakash Kumar and not this petitioner.

No.19182 of 2015 (3) dt.18-09-2015 Considering the aforementioned facts and circumstances that there being no further cogent material in the case diary so as to implicate the petitioner and also because the petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No.169 of 2015 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
