The petitioner seeks bail in N.D.P.S. Case No. 16 of 2016 arising out of Udawantnagar P.S. Case No. 295 of 2016, instituted for the offences under Sections 20(B)(ii)(C)/22(C) of the N.D.P.S. Act.

The bail application of this petitioner was earlier twice rejected by coordinate Bench of this Court vide order dated 12.07.2017 and 28.02.2018 passed in Cr. Misc. No. 30050 of 2017 and Cr. Misc. No. 10327 of 2018 respectively. A report was called for from the concerned court below, regarding stage of the trial and estimated time whereunder trial is likely to be concluded, which has been

Patna High Court Cr.Misc. No.53604 of 2018(3) dt.05-10-2018 2/2 received. The court below has mentioned in the report that trial is likely to be concluded within two months.

Hence, this bail application is disposed of with the direction to the court below to make all effort to conclude the trial within a period of three months from date of receipt of this order and send compliance report. Petitioner is given liberty to renew his prayer for bail after three months in the event trial is not concluded within aforesaid period.
