JUSTICE SANJAY PRIYA ORAL ORDER 05-10-2018 Heard learned counsel for the petitioner, learned APP for the State, and learned counsel for the informant. The petitioner seeks bail in Gopalpur P. S. Case No. 215 of 2017 instituted for the offence under Section(s) 302/201 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner has been implicated in this case merely on suspicion. He is brother-in-law of co-accused Vinay Pandey. Learned counsel for the petitioner submits that co-accused Babita Devi has already been granted regular bail by order dated 26.07.2018 passed in Cr. Misc. No.42403 of 2018.
Learned APP for the State has submitted that statement of Deepak Pathak, brother of the deceased has been recorded under Section 164 Cr.P.C wherein he has taken the
Patna High Court Cr.Misc. No.51586 of 2018(3) dt.05-10-2018 2/2 name of this petitioner. Learned counsel for this petitioner has submitted that his statement under Section 164 Cr.P.C. was recorded after six months of the occurrence. Petitioner is in custody since 19.03.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge -IX cum ACJM 9, Patna, in connection with Gopalpur P. S. Case No. 215 of 2017 subject to the condition that both the bailers shall be the close relative of the petitioner.
