JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Rajoun P.S. Case No. 556 of 2017, registered for the offences under Sections 341, 323, 379, 494, 498A, 504 and 506/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Allegation as per F.I.R. against the petitioner is of committing torture upon the victim due to non fulfillment of demand of dowry and the petitioner, happens to be husband of the informant tried to ousted the victim girl from his house. Submission of the learned counsel for the petitioner is that the informant was earlier filed a Complaint petition with

Patna High Court Cr.Misc. No.52191 of 2018 (4) dt.04-10-2018 2/2 respect to the same allegation but there is no specific allegation of demand of dowry against the petitioner and the petitioner is ready to keep the informant with full honor and dignity and he is in custody since 04.05.2018 and one of the co-accused has been granted bail by Co-ordinate Bench of this Court vide order dated 16.08. 2018 passed in Cr. Misc. No. 50372 of 2018. Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S.Case No. 556 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
