JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-03-2017 The petitioner filed this petition for modification of order dated 24.06.2015 passed in Cr. Misc. No. 11392/2015 and for extension of time to surrender the petitioners in court. The petitioners Pramod Yadav @ Pramod Kumar and Sandeep Yadav were granted anticipatory bail vide order dated 24.06.2015 passed in Gopalganj Town P.S. Case No. 443/2013.

Learned counsel for the petitioners submits that the petitioners could not understand the order passed in Cr. Misc. No. 11392/2015 and they went outside for their livelihood. Therefore, they could not surrender in court.

It appears that there is no such condition that the petitioner could not understand the order dated 24.06.2015. The petitioners did not surrender in Court and the grounds stated in this

Patna High Court Cr.Misc. No.11318 of 2017 (2) dt.08-03-2017 2/2 petition do not appear to be convincing and reasonable. It is sheer laches on the part of the petitioners, who did not surrender in court within prescribed time and filed this petition for modification only after more than one and half years.

Considering the facts aforesaid, I do not find any merit in this modification petition. Accordingly, the modification petition is dismissed.
