JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner, in the present case, is seeking regular bail in connection with K. Hat (Maranga) P.S. Case No. 607 of 2017, registered for offences alleged under Sections 341 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that even though there is an allegation of firing against this petitioner as also against co-accused Shippy Singh @ Sippeya, but the fact remains that no injury has been caused to the informant. It is further stated that the co-accused Shippy Singh @ Sippeya has been granted regular bail by a learned coordinate Bench of this Court in Cr.Misc.No.28567 of 2018.
Patna High Court Cr.Misc. No.52499 of 2018 (3) dt.28-09-2018 2/2 Learned APP for the State is present and has opposed the prayer for bail.
Considering the facts and circumstances of the case whereunder the co-accused has already been granted regular bail by a learned coordinate Bench of this Court and no injury is said to be caused to the informant, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K.Hat (Maranga) P.S. Case No. 607 of 2017, subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that the petitioner shall cooperate in course of trial by putting appearance before the learned court below. Two consecutive defaults in putting appearance before the learned court below without any plausible reason would lead to cancellation of his bail bond.
