The petitioners are aggrieved by the order dated 4th August, 2014 read with order dated 16.10.2014 passed in B.L.T.

Patna High Court CWJC No.6070 of 2015 (2) dt.17-09-2016 2/2 Case No. 856 of 2013 by the learned Bihar Land Tribunal, Patna, as contained in Annexure-5 to the writ petition, whereby while allowing the aforesaid B.L.T. case filed on behalf of the private respondent no. 6 and others, the matter has been remitted back to the respondent Circle Officer, Baisi with a direction to decide the Case No. 6 of 1997-98 originally filed by the petitioners, besides others, under Section 48D of the B.T. Act.

In view of the order of remand made by the learned Tribunal and in view of the fact that the case u/s 48D of the B.T. Act shall be decided afresh in accordance with law, this Court does not feel persuaded to interfere with the impugned order passed by the learned Tribunal.

The writ petition is devoid of merit and is, accordingly, dismissed, but without costs.
