2. The petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, there is recovery of 51.840 litres of foreign liquor from Bolero vehicle bearing Registration No. BR03P8892 and the seized vehicle was driven by the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He has no concern with the seized liquor or Bolero vehicle in question. Petitioner is not the owner of the seized vehicle. Nothing incriminating material was recovered from the
Patna High Court CR. MISC. No.56106 of 2025(3) dt.18-09-2025 2/2 conscious possession of the petitioner. Petitioner has no criminal antecedent. He is in custody since 03.07.2025. Petitioner undertakes to co-operate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Motihari, East Chaparan, in connection with Excise Madhuban P.S. Case No. 126 of 2025.
