JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On account of dispute over irrigation from a pond, it has been alleged that deceased along with his brother Mahesh Das and co-villager Nepali Das was gossiping. Ranjay Yadav (petitioner) along with Pankaj Mahto came, abused and during course thereof, they were joined by 5-6 persons. Then thereafter, Ranjay and Pankaj caught hold deceased Ganesh Das, dragged towards road and then, Pankaj Mahto confined Ganesh with towel and Ranjay began to assault with brick particle. Thereafter, he also gave Chhura blow. Apart from consistent version of prosecution witnesses, post mortem suggest presence of six ante-mortem injuries, out of which injury no.1 has been caused by sharp cutting weapon while injury no.2 to 6 by means of hard and blunt

Patna High Court Cr.Misc. No.17866 of 2015 (03) dt.29-06-2015 substance. On dissection, parietal bone has been found fractured. Cranial cavity has been found full of pool of blood and blood clot. Brain matter was lacerated and deceased died on account of conjoint effect of aforesaid injuries.

Accordingly, prayer of petitioner for bail is rejected. (Aditya Kumar Trivedi, J) Vikash/- U T
