Petitioner is in custody in connection with Kundwa Chainpur P.S. Case No. 103 of 2019 for the offence under section 272, 273 and 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Learned counsel submits that 36 liters of Nepali wine was seized from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 4.7.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.53942 of 2019(2) dt.30-08-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IXth cum Special Judge Excise, East Champaran at Motihari, in connection with Kundwa Chainpur P.S. Case No.103 of 2019.
