The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Anuj Kumar, Advocate For the Opposite Party/s : Smt. Madhuri Lata ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in connection with a case registered under Sections 25 (1-B), 26/35 of the Arms Act. Allegation in brief is that the petitioners planted arms and got the informant implicated in Nawada Town P.S. Case No.34 of 2016 as it was found after investigation in the said case. Learned counsel appearing on behalf of the petitioners submits that earlier case was lodged against Vinod Kumar and was handed over to the police along with the arms but there is nothing to connect the petitioner that he had planted the arm. Moreover, there is no criminal antecedent against these petitioners except one another case lodged by the informant in which he is on bail.

Patna High Court Cr.Misc. No.5591 of 2017 (2) dt.07-02-2017 2/2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Vijay Kumar, Nandlal Prasad and Ajay Kumar @ Ajay Prasad be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S.
