JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This is an application for grant of anticipatory bail in connection with Basnahi P. S. Case No. 58 of 2018, disclosing offences under Sections 341, 323, 324, 379, 504, 34 of the Indian Penal Code.

There is allegation against the petitioner and other accused persons of assault to the informant and his brother and the specific allegation against the petitioner is of assault by rod. It further appears that occurrence took place when the informant went to demand dues from the petitioner.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties. Injuries are simple in nature and moreover, petitioner is a lady. It has also been submitted that co-accused having similar allegation has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 20.05.2019 passed in

Patna High Court CR. MISC. No.53974 of 2019(2) dt.28-08-2019 2/2 Criminal Misc. No. 32892 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., III, Saharsa, in connection with Basnahi P.
