The petitioner is languishing in custody in connection with Kishanpur P.S. Case No. 99 of 2015 for the offences instituted under Sections 302/120(B)/34.
There is allegation against the petitioner is that petitioner along with his family members killed the informant's sister namely Sabiya Parven along with her eight years old son Md. Kaushar, due to non-fulfillment of demand of dowry. It has been submitted on behalf of the petitioner that petitioner is in custody since 02.04.2016. Charge sheet has been submitted in this case. There is no criminal antecedent against the petitioner. There is no allegation of tampering of the witnesses
Patna High Court Cr.Misc. No.23000 of 2016 (4) dt.03-08-2016 2/2 against the petitioner. Petitioner has been named on the basis of suspicion. There is no circumstantial evidence to suggest the implication of the petitioner in the present case. There is no eyewitness to the alleged occurrence. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No. 99 of 2015.
