JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Muffasil P. S. Case no. 37 of 2017 instituted for the offence under Sections 420, 467 and 468 of the Indian Penal Code and Sections 63 and 65 of the Copy Right Act and 103 and 104 of the Trade Mark Act, 1999. Allegation against the petitioner is that 18 bags of about 25 kg. duplicate "Super Chand Tara Gul" were recovered from the premises of the petitioner. The informant is said to be the Area Manager of the aforesaid company.
It has been submitted on behalf of the petitioner that the case has been filed because of business rivalry. It is further submitted that this is a case under Sections 63 and 65 of the Copy Right Act and 103 and 104 of the Trade Mark Act triable by court
Patna High Court Cr.Misc. No.14530 of 2017 (2) dt.29-03-2017 2/2 of Magistrate. It is mentioned in para-3 of the petition that petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Muffassil P.S. case no. 37 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) Cr. P.C.
