JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Hathidah P.S.Case No. 52 of 2012 registered u/s 147, 148, 149, 307, 504 and 506 IPC and 27 of the Arms Act.

Allegation has been made that on 19th November 2012 accused persons came to the Darwaja of the informant and started resorting to firing. Accused Vijay Singh and Moti Kumar ordered to kill upon which Mukesh Kumar @ Muko, Gya Prakash @ Tony and Shyam Bahadur Singh fired indiscriminately as a result of which Hareram Singh and Raushan Kumar sustained injuries.

Counsel for the petitioner submits that there is no specific allegation against the petitioner. He is only a member of

Patna High Court Cr.Misc. No.17984 of 2015 (3) dt.09-06-2015 2/2 the mob. Accused Ramji Singh and Ramadhar Singh have been granted anticipatory bail vide Cr.Misc.No.37595 of 2014 and the case of present petitioner is on better footing. Looking to the facts and circumstances of the case, petitioner Sanjay Kumar, on surrender within six weeks from today, is directed to be released on anticipatory bail on his furnishing bail bond of Rs.10,000-/ (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna in Hathidah P.S.Case No. 52 of 2012 subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.

He will co-operate the investigation, also submit himself for Police interrogation when it is required. In failure, the court below will be at liberty to cancel the bail of the petitioner. Jay/- (Shivaji Pandey, J) U
