JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/ 511, 323 of the Indian Penal Code.

The prosecution case is that the petitioner called the informant for harvesting the mustard crop but he started indecent behaviour with her and pulled her sari and made an attempt to ravish her and when her son came to rescue her then the petitioner assaulted the son of the informant and threatened not to disclose the incidence. It is submitted by learned counsel for the petitioner that for a petty dispute with regard to the wage the accusation has been levelled and even assuming the accusation, at best the case under Section 354 I.P.C is made out. The petitioner has also lodged Complaint Case No. 304 of 2016 levelling accusation against the informant and her family members under Sections 323, 341, 380, 452, 406, 34 of the

Patna High Court Cr.Misc. No.23455 of 2016 (2) dt.25-05-2016 2/2 Indian Penal Code though subsequent to the present case. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Naubatpur P.S. Case No. 80 of 2016, pending in the Court of learned Additional Chief Judicial Magistrate, II, Danapur, Patna.

With the observations above, the application stands disposed off.
