JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,307,353,504,506 and 427 of the Indian Penal Code.
The prosecution case, as per the informant being Officer Incahrge of Sheohar Police Station, is that on 27.2.2016 at 2.45 P.M. he arrested notorious criminal namely Sri Narain Singh and
Patna High Court Cr.Misc. No.23694 of 2016 (2) dt.26-05-2016 2/2 four others and registered Sheohar P.S. Case No. 32 of 2016 but the crowd made protest and tried to get the apprehended accused released. The crowd raised slogans against the police and thereby obstructed the police force in discharge of official duty. It is submitted by the learned counsel for the petitioners that the accusation is omnibus and genral against the mob. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sheohar in connection with Sheohar P.S. Case No. 33 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
