JUSTICE PURNENDU SINGH ORAL ORDER 09-01-2023 Heard Mr. P.K. Shahi, learned Senior Counsel appearing on behalf of the petitioner and Mr. Anjani Kumar, learned AAG-4 for the State.

In the present writ petition, the petitioner has prayed for following reliefs:

"a. For directing the respondents to discharge their liability and pay the petitioner the outstanding amount of fees payable as per the bills raised.

b. For issuance of a writ of mandamus directing the respondents to adhere to the contents of its own letter dated 06.09.2017 whereby the petitioner was provided with a tabulation about the bills raised, amount paid, TDS deposited and amount outstanding and also that the

9058 dated 06.09.2017.

c. Call for the original file and the opinion of the Law Department and if required refer the matter for investigation so that the conspiracy by vested interest is exposed and the guilty are appropriately dealt with.

d. For any other relief/reliefs which is deemed fit on the facts and circumstances of the case and in the interest of justice."

At the outset, Mr. P.K. Shahi, learned Senior Counsel appearing on behalf of the petitioner submitted that petitioner has already filed his representation on 29.01.2020 giving the detail regarding the period from which he has not been paid before the Chief Secretary, Government of Bihar is still pending till date. The same be directed to be disposed of. Mr. Anjani Kumar, learned AAG-4 has opposed such prayer made on behalf of the petitioner and submitted that recently the Appex Court has made a remark that an advocate filing a writ petition for fee is unprofessional because legal profession is noble profession and such writ petition is not maintainable. The petitioner can avail appropriate remedy in accordance with law.

Considering the specific prayer made by Mr. P.K.

Patna High Court CWJC No.19977 of 2021(3) dt.09-01-2023 3/3 Shahi, learned Senior Counsel for the petitioner that his representation is pending before the Chief Secretary, Government of Bihar since the year 2020 it would be proper for the petitioner, if so advised, may approach the Chief Secretary, Government of Bihar who is directed to dispose of the representation expeditiously.
