Petitioner seeks bail in NTPC P.S. Case No.42 of 2018 instituted for the offence under Section(s) 327, 356, 384, 386, 387, 401, 414 Indian Penal Code and Section 37-B of the Excise Act.

In the written report, it is alleged that petitioner was apprehended with motorcycle, which is alleged to be stolen motorcycle. It is also alleged that smell of liquor was coming from his mouth.

Counsel for the petitioner submits that no separate case has been lodged by anybody before the police with regard to recovered motorcycle from possession of the petititioner. It is mentioned in para 3 of the bail petition that

Patna High Court Cr.Misc. No.53656 of 2018(4) dt.26-11-2018 2/2 petitioner has seven cases pending against him. It is submitted that petitioner is on bail in all those cases. Petitioner is in custody since 09.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise Act, Bhagalpur, in connection with NTPC P.S. Case No.42 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
