JUSTICE S. KUMAR ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner, State as well as learned counsel for opposite party nos. 7 and 8. A supplementary affidavit has been filed on behalf of opposite party nos. 7 and 8 in which it has been stated that pursuant to orders passed by the Teachers Appellate Tribunal and the Hon'ble High Court, petitioner has been appointed on 19.08.2017 and the order passed by the High Court has been complied. However, learned counsel for the petitioner states that pursuant to the circular issued by the State of Bihar dated 04.07.2008 (Annexure-a) by which Shiksha Mitras who were removed from service for the reason of not having the educational qualification, i.e., Intermediate were to be reinstated in service from the date of their removal. In said view of the
Patna High Court MJC No.1071 of 2014(18) dt.04-01-2018 2/2 matter, petitioner is to be reinstated in service from the date of his removal. It is clarified that the petitioner is entitled to get service benefits including continuity of service from the date of removal till reinstatement except payment of salary from the date of removal till the date of joining.
With the aforesaid observation, the contempt proceeding is dropped. The M.J.C. petition stands disposed of. (S. Kumar, J) sudip/- U
