Petitioner seeks bail in a case registered under section 364 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, one co- accused Ranjeet Paswan was arrested with the vehicle which had been used in the alleged occurrence. The aforesaid apprehended co- accused Ranjeet Paswan disclosed the names of his associates including the petitioner. Subsequently, petitioner was, too, arrested and confessed his guilt. It appears from perusal of the entire case diary that except the aforesaid materials as well as criminal antecedent of the petitioner, there is nothing against him.

Moreover, having more or less similar allegation one coaccused Bijali Paswan has already been granted privilege of bail by a

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Vishnupad P.S. Case no. 05/2016.
