The petitioner seeks bail in Kotwali ( Munger) P. S. Case No. 206 of 2018 instituted for the offence under Section(s) 420, 379 of the Indian Penal Code and Section 66( C) of the Information Technology Act.
Petitioner is man of clean antecedent. He is in custody since 6.6.2018.
In the written report, it is alleged that informant had gone to withdraw the money from ATM. In the meantime, one person snatched his ATM card on the pretext that he will know how to withdraw the money from ATM card. The informant apprehended that person with the help of public and made
Patna High Court Cr.Misc. No.52837 of 2018(3) dt.05-10-2018 2/2 demand of his ATM Card then he told that ATM card has been given to co-accused Vicky @ Kismat who has managed to run away. The police made search of person and premises of Ram Medical Hall and seizure list was prepared from which it appears that four different ATM cards have been recovered from premises of Ram Medical Hall.
Learned counsel for the petitioner has submitted that there is no allegation that ATM card of the informant was misused by the petitioner. There is no recovery of ATM card from conscious possession of the petitioner. ATM cards were recovered from the premises of Ram Medical Hall. Petitioner is a student and is resident of Purnea. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Munger, in connection with Kotwali ( Munger) P. S. Case No. 206 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
