The petitioner seeks anticipatory bail in connection with Mahishi P.S. Case No. 22 of 2013 registered for the offences punishable under sections 406, 409, 420, 467, 468, 469, 471 and 120-B read with 34 of the Indian Penal Code.

It is contended that initially a complaint was filed which was referred to the police under section 156(3) of the Code of Criminal Procedure pursuant to which the instant FIR was registered. In course of investigation, save and except suspicion, nothing has transpired as against the petitioner. Learned counsel for the State has opposed the prayer for bail.

No.18174 of 2015 (4) dt.19-08-2015 2/2 Regard being had to the nature of dispute, in the event of arrest or surrender before the court below within four weeks from today, the petitioner Dinesh Kumar @ Dinesh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 22 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
