====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-11-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner seeks regular bail in connection with Sasaram (Model) P.S. Case No. 668 of 2017 registered under sections 302, 120(B) of the IPC and Section 27 of the Arms Act. The allegation against the petitioner is that the petitioner along with other accused person fired upon the brother of the informant resulting to his death.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. Learned counsel further submits that from perusal of the first informant report, it is evident that the petitioner is not the main assailant and the main assailant is one Kallu Khan @ Firoz Khan. Learned counsel further submits that the petitioner has got clean antecedent. Learned counsel further submits that the petitioner is in custody since 06.07.2019.

No.53396 of 2019(3) dt.25-11-2019 2/2 After having heard learned counsel for the parties and taking into consideration the fact that the petitioner is not the main assailant and the petitioner has no criminal antecedent, therefore, I am inclined to grant regular bail to the petitioner. Accordingly, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram, District Rohtas in connection with Sasaram (Model) P.S. Case No. 668 of 2017.
