JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mahua P.S. Case No. 203 of 2016 instituted for the offence under Sections 406 and 379/34 of the Indian Penal Code.

The informant is driver of Bolero vehicle. He has alleged in the written report that he parked the aforesaid Bolero vehicle in the garage of one Baleshwar Paswan. On 20.5.2016 in the morning he did not find the vehicle. The garage owner did not give satisfactory reply about it. Thereafter, he informed the owner of the vehicle. It is suspected that the garage owner i.e. the petitioner herein has got the Bolero vehicle disappeared. The counsel for the petitioner has submitted that the petitioner has no concern with the garage of Baleshwar Paswan.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Mahua P.S. Case No. 203 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
