The petitioner seeks bail in Madhepura (Ghailarh O.P.) P.S.Case No.170 of 2017 registered for the offences under Section 147, 148, 149, 341, 323, 324, 307, 447, 504, 506 and 302 of the I.P.C.
Allegation as per the F.I.R. is that 13 named accused persons and 20-25 unknown persons came variously armed and demanded rangdari from the shop of the informant and they also assaulted the deceased.
Submission on behalf of the petitioner is that the specific allegation is against eight accused persons who are on bail and the petitioner has also been named but there is general and omnibus allegation against the petitioner and there is case and counter case.
Patna High Court Cr.Misc. No.52862 of 2018 (3) dt.05-10-2018 2/2 The petitioner is in custody since 18.05.2018 having no criminal antecedent.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Madhepura, in Madhepura (Ghailarh) P.S.Case No.170 of 2017 subject to the condition that one of the bailors must be of local person having sufficient properties within the jurisdiction of the court concerned.
