This application for anticipatory bail arises out of Harsidhi P.S. Case N0. 477 of 2018, disclosing offences under Sections 323,341,324,307/34 of the Indian Penal Code.

It is evident from the First Information Report that the informant and the persons named in the First Information Report are agnates. There is allegation against all of them of having assaulted the informant with sharp cutting weapon and iron rod.

Learned counsel appearing on behalf of the petitioner has submitted that the land dispute is there between the parties and so far this petitioner is concerned, though there is against him of having assaulted the informant with a sharp cutting weapon, no injury caused by

Case diary was called for, which is there on record. The injury report does not show that the informant received any injury caused by sharp cutting weapon, though the injury has been described to be grievous in nature. Considering the genesis of the occurrence and the fact that the allegation against the petitioner is not corroborated by the injury report, a case for grant of anticipatory bail is made out. This application is allowed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Harsidhi P.S. Case No.

477 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
