Petitioner is in jail custody since 7.4.2016 in a case registered under section 395 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that name of the petitioner and several other co- accused came in the confessional statement of co- accused persons. Furthermore, the impugned order goes to show that looted vehicle was recovered but not from possession of the petitioner.

Learned counsel for the petitioner points out that coaccused Jay Ram Yadav, having similar allegation, was granted bail by learned Addl. Sessions Judge I, Gaya but the same court rejected the prayer for bail of the petitioner.
