JUSTICE SUDHIR SINGH ORAL ORDER 07-04-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Barun P.S. Case No. 04 of 2017 for the offences instituted under Sections 147, 148, 149, 452, 341, 323, 354, 379 and 308/504 of the Indian Penal Code.

The prosecution case, in brief, is that while the husband of the informant was passing through barn of the accused persons, the petitioners namely Arjun Prasad Singh, Alok Kumar Singh and Satyendra Singh detained and abused in filthy language and also hurled indiscriminate blows on him. They further assaulted him and the informant and mother-in-law of the informant. The allegation against petitioner Mukesh Kumar Singh and Jitendra Kumar are alleged to have caught the informant with ill motive and tore her blouse and began to unclothe her. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are the agnates of the informant. Due to property dispute, the alleged occurrence is said to have taken place. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Barun P.S. Case No. 04 of 2017 on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to
