JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 135 of Electricity Act. The accusation is of consumption of electric energy unauthorizedly and the loss has been calculated to the tune of Rs.1,45,675/-.

The petitioner undertakes to deposit 25% of the loss calculated amount. The said deposit will be subject to the final assessment or compounding proceeding.

Considering the present stand of the petitioner, on deposit of 25% of the loss calculated amount let the above named petitioner be released on provisional anticipatory bail for six

No.19350 of 2015 (2) dt.30-04-2015 2/2 months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity) Magadh Area, Gaya in connection with Sherghaty P.S. Case No. 67 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner shall be confirmed by the learned court below on being shown the receipt of the authorities of deposit of entire loss calculated amount within the aforementioned period.
