Having regard to the nature of allegation for offence under Section 47(A) of the Excise Act, since the petitioner earlier also has criminal antecedent at least in two cases including one under Section 47 of the Excise Act, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. When such an observation has been made, learned counsel for the petitioner seeks permission to withdraw this application.
That being so, this application is accordingly dismissed as withdrawn.
