JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 11-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Unknown miscreants took away three tractors with trailer along with other items after overpowering the occupant from a brick-kiln of which, informant Ashok Das was a caretaker and accordingly, F.I.R. was registered against unknown. It is evident from the case diary that police during course of investigation conducted raid at Shukla Residential Hotel lying at Hajipur Town and during course thereof, apprehended five persons, out of whom, Amarjit Kumar was firstly searched out, interrogated and from his possession, a looted mobile set was recovered, who had made inculpatory extra-judicial confessional statement detailing the minute to minute detail of the occurrence

Patna High Court Cr.Misc. No.50416 of 2018 (02) dt.11-09-2018 and also shown complicity of the petitioner, who was also apprehended at the Shukla Residential Hotel and from his possession as is evident, one Samsung Mobile Set was seized, does not belong to the subject matter of instant case. Nothing more has been collected against him.

That being so, petitioner, Akhilesh Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P. S. Case No.35 of 2018.
