The petitioner seeks bail in Kawakole P. S. Case No. 186 of 2017 instituted for the offence under Section(s) 147,148,149,341, 323, 324, 307,504 abd 506 Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is in custody since 29.6.18 . One of the co accused, namely, Sarekh Yadav with similar allegation has already been granted regular bail by coordinate Bench of this court by order dated 3.5.18 passed in Cr. Misc. no. 17425 of 2018. In the written report, there is allegation that son of Brahamdev Yadav assaulted the informant and his brother. Case diary has been received wherein the injury report
Patna High Court Cr.Misc. No.52692 of 2018(3) dt.26-09-2018 2/2 of the informant and his brother are available which shows that doctor has found only swelling and tenderness, abrasion etc. on the person of the injured(s).
It has been submitted that informant and petitioner are agnate. There is land dispute between the parties. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Nawada, in connection with Kawakole P. S. Case No. 186 of 2017 G.R. No. 3204 of 2017 subject to the condition that both the bailers shall be the close relative of the petitioner.
