Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation, some witnesses claimed to have seen the petitioner and others moving on motorcycle and subsequently, some witnesses claimed to have seen the petitioner and others fleeing from the place of occurrence. Furthermore, I find from perusal of the impugned order that one co- accused Niranjan Yadav was arrested and confessed his guilt disclosing the name of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.28060 of 2016 (3) dt.18-07-2016 It would appear from the material available on record that except the above stated material, there is nothing against the petitioner.

Moreover, having more or less similar allegation coaccused Bajrangi Mandal has already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Bhagalpur in Nathnagar P.S. Case no. 07/2016. shahid (Hemant Kumar Srivastava,J) U T
