====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 26-11-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 324 and 307/34 of the IPC. The prosecution story, in brief, is that in the year 2016, the petitioner has taken Rs. 5,10,000/- from the informant Santosh Kumar Rai. After that, in year 2017, petitioner has paid Rs. 1,10,000/- cash and a cheque regarding rest Rs. 4,00,000/-. On 17.05.2018 at 11.30 A.M. in the day, when the informant reached at the house of the petitioner then the petitioner enquired about the said cheque and with intention to kill him, opened fire by Katta on him which hit on his neck and he fell down and when he tried to flee from there then wife of petitioner has fired twice by Double Barrel Gun on him.

Patna High Court Cr.Misc. No.51772 of 2018(3) dt.26-11-2018 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has falsely implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Relating to same occurrence, two F.I.Rs., were instituted. Petitioner denies the allegation made in F.I.R.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Specific allegation of firing is alleged against the petitioner. Injury report corroborates the allegation made in the F.I.R. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in connection with Buxar Town P.S. Case No. 253 of 2018, G.R. No. 1519 of 2018, pending in the court of learned C.J.M., Buxar. Anyhow, if the petitioner surrenders and prays for regular bail in the learned court below, the same shall be considered on its own merit without being prejudiced by this order of the Court.
