JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341, 323, 307, 594 and 34 of the Indian Penal Code.

It is alleged that the petitioner gave khanti blow on the head of brother of the informant.

The Sessions judge has mentioned in the impugned order that injury on the person of the brother of the informant namely, Rambali Manjhi, was incised wound 3 1⁄2" x 1⁄2" x 1⁄2" on the head.

From the impugned order, it appears that there is no repetition of blow. It has further been submitted that there is counter case in which three persons from the side of the

It is mentioned that occurrence had taken place for fishing. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest within six weeks from the date of receipt of this order, in connection with Roh P.S. Case No. 55 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438
