The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 379 of the Indian Penal Code. Later on, Section 302 of I.P.C. has been added. Prosecution case, in short, is the accused persons including the petitioner abused and assaulted the husband of the informant, namely, Ugam Mahto, causing head injury. Subsequently, the husband of the informant succumbed to the injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.7.2019 and has got no criminal antecedent. There is no allegation of tampering of

Neither any specific overt act is alleged nor any specific injury is attributed against the petitioner. General and omnibus allegation has been made. Other co-accused have been granted bail vide Annexure 2 and 2/1 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with G.R. case No.4575 of 2018 arising out of Govindganj (Malahi) P.S. case No.196 of 2018.
