The petitioner is in custody since 15.05.2018 in connection with Beldaur P.S. Case NO. 04 of 2017 for the offence registered under Sections 341, 323, 387, 504, 506, 307 and 34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act.

Learned counsel for the petitioner submits that though the date of occurrence is 04.01.2017 at 6:30 P.M., the injury report of the informant is dated 04.01.2017 at 9:30 A.M. He, thus, submits that now the case of the informant comes under a distinct cloud and the petitioner is entitled to the benefit of bail. Diary of the present case was called for which has since been received.

Considering the aforesaid facts having been substantiated in the case diary particularly the injury report, let the
