JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 22-06-2016 This case has been brought under the heading "To be Mentioned" as progress report dated 01.06.2016 had noted that the case has been disposed of. The order, as recorded and signed, does not reflect the same.
Mr. Ajay Kumar Thakur, learned counsel for the petitioner submits that in fact the matter has been heard and the petitioner had been granted bail. The bail was dictated in Court but, apparently, due to mistake, a wrong order has been signed. The Personal Assistant, Ms. Deepika Singh, who had taken down the dictation, has produced the note book which discloses that in fact detailed order granting anticipatory bail had
Patna High Court Cr.Misc. No.24561 of 2016 (03) dt.22-06-2016 2/3 been passed but, by mistake, only part of the order was typed. Learned counsel for the State also does not dispute this position.
Considering the aforesaid facts, let the order as dictated on 01.06.2016 in the Court be recorded today as order of 01.06.2016.
The petitioner apprehends his arrest in relation to Madhubani Town P.S. Case No.55 of 2016 instituted for the alleged offences under Sections-406, 420 and 409 of the Indian Penal Code.
The petitioner has been made an accused amongst others, being the Assistant Manager/Incharge of Procurement Centre of Harlakhi and Basopatti. The petitioner superannuated on 31st of January, 2014 and when he handed over the charge no complaints were made in regard to the stock to which he was associated. Subsequently, in 2016 an F.I.R. now being lodged with regard to transaction which took place in the year 2011 to 2013.
Be that as it may, in the event of arrest or surrender within four weeks from today, the petitioner, namely, Prabhu Nath Singh, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like
