The petitioner is aggrieved by the order dated 09.03.2007 (Annexure-6) passed by the Superintendent of Police, West Champaran, Bettiah, whereby he has been visited with the punishment of dismissal from service.

Learned counsel appearing on behalf of the petitioner submits that, against the impugned order of punishment, the petitioner has filed a statutory appeal before the respondent D.I.G. of Police, Champaran Range, Bettiah, but, despite passage of quite a long time, neither the aforesaid appeal has been disposed of nor the valid grievances of the petitioner have been redressed. Though, a counter affidavit has been filed on behalf of the respondent no.4, but the learned State counsel has fairly submitted that there is no averment in the aforesaid counter affidavit about the disposal of the statutory appeal preferred by the petitioner.

In above view of the matter, the present writ petition is

Patna High Court CWJC No.7218 of 2014 (2) dt.12-01-2015 disposed of with a direction to the respondent no.3, the D.I.G. of Police, Champaran Range, Bettiah, to take up the appeal of the petitioner, if not already disposed of, on priority basis and shall dispose it of by a reasoned and speaking order at an early date preferably within a period of one month from the date of receipt/production of a copy of the present order. The writ petition stands finally disposed of with the observations and directions made above.
