JUSTICE RAKESH KUMAR ORAL ORDER 18-06-2015 The sole petitioner, apprehending his arrest in connection with Ghoshwari (Samyagarh) P.S. Case No. 37 of 2014, registered for the offence under Section 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act, has prayed for grant of anticipatory bail.

It appears that from the alleged 'Gumti' of the petitioner 52 pouches containing 200 ml. country made liquor each were recovered. It has been alleged in the F.I.R. that after noticing the Police the accused persons fled away. In view of the nature of accusation and recovery, the court is of the opinion that it is a fit case for extending the privilege of anticipatory bail to the petitioner. No.20689 of 2015 (2) dt.18-06-2015 2/2 today, let the petitioner namely, Dharmendra Kumar @ Munchun be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjay Kumar, learned Judicial Magistrate 1st Class, Barh, District- Patna in connection with Ghoswari (Samyagarh) P.S. Case No.37 of 2014 in terms of the conditions as contemplated under Section 438(2) of the Cr.P.C.
