The petitioners pray for bail in connection with Hulasganj P.S.Case No. 26 of 2018 registered for the offences punishable under Sections 148, 149, 341, 323, 504, 506, 307 and 324 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and there is specific allegation of assault against three other accused persons by Tangi and other weapons to the husband of informant, who died later on and as such charge sheet has been submitted under Section 302 IPC.
Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the petitioners
Patna High Court Cr.Misc. No.51984 of 2018 (3) dt.12-10-2018 2/2 and there is case and counter case between the parties and though there is allegation of assault to the informant but the injury is simple in nature and petitioners are in custody for six months and charge sheet has already been submitted in this case. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri R.K. Rajak, A.C.J.M., Jehanabad, in connection with Hulasganj P.S.Case No. 26 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
