JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302, 201 and 379 of the Indian Penal Code. The allegation against the petitioner is of killing the cousin of the informant.

It is submitted on behalf of the petitioner that the petitioner is in custody since 16.12.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has come on the confessional statement of co-accused. Co-accused has been granted bail vide B.P. No. 186 of 2015 on 11.03.2015 by the learned Additional Sessions Judge-IV, Sasaram.

Patna High Court Cr.Misc. No.24999 of 2016 (3) dt.18-08-2016 2/2 On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Sasaram in connection with Sessions Trial No. 155 of 2016 arising out of Dehari (T) P.S.Case No. 457 of 2014.
