JUSTICE BIRENDRA KUMAR ORAL ORDER 06-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 353, 506 and 349 of the Indian Penal Code.

Allegation against the petitioners is that they have obstructed in discharging the official duty of the informant. Submission is that since the informant was partisan in the matter some altercation had only taken place. Considering the aforesaid facts, let the petitioners,

Patna High Court Cr.Misc. No.14716 of 2017 (2) dt.06-04-2017 above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court in connection with Mohania P.S. Case No.70 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
